Regulations
Section 4 of the Norwegian Health Personnel Act requires organisations to ensure that staff are qualified and practise their profession responsibly. Reference checking is a central part of this duty-of-care assessment. The Personal Data Act and GDPR also apply — you need a legal basis (typically legitimate interest under art. 6(1)(f) or legal obligation for public actors under art. 6(1)(c)). Questions must be relevant to the role and patient safety, and you must not register health data about the candidate themselves (special category, art. 9). A police certificate under Section 20a of the Health Personnel Act is required in addition.
